JUNK REMOVAL SERVICE AGREEMENT

This Service Agreement ("Agreement") is entered into by and between ClearPaths ("Company") and the undersigned customer ("Client") for the provision of junk removal services. By booking our services, you agree to be bound by the terms and conditions outlined below.

1. Scope of Services

The Company agrees to perform junk removal services, which may include pickup and disposal of non-hazardous materials such as furniture, appliances, debris, and general household or office items, at the location specified by the Client. Services do not include the removal of hazardous materials (e.g., paint, solvents, chemicals, asbestos, biological waste, firearms, or explosives).

2. Booking and Scheduling
  • All appointments must be scheduled in advance through our online booking system or by contacting our office.

  • Client must provide accurate information regarding location, item types, and access conditions.

  • The Company reserves the right to adjust or cancel appointments due to weather, safety concerns, or operational issues.

3. Estimates and Pricing
  • Online or phone estimates are non-binding and based on the information provided by the Client.

  • Final pricing will be confirmed onsite based on actual volume, weight, labor, accessibility, and materials.

  • If the Client declines service after the onsite estimate is provided, a trip fee may be charged (Typically $50.00)

4. Payment Terms
  • Payment is due immediately upon completion of service unless otherwise agreed in writing.

  • Accepted payment methods include [list accepted forms – e.g., cash, credit/debit cards, digital payments].

  • Invoices not paid within 5 business days are subject to a late fee of 20% per extra day

  • 5. Client Responsibilities

By entering this Agreement, the Client agrees to:

  • Provide safe and legal access to the removal site.

  • Ensure that all items for removal are clearly marked or separated.

  • Secure pets, valuables, and fragile items prior to service.

  • Not request the removal of prohibited or hazardous items.

6. Cancellations & Rescheduling
  • Client must provide at least 24 hours’ notice for cancellations or rescheduling.

  • Cancellations made with less than 24 hours’ notice may be subject to a $50.00 cancellation fee.

  • No-shows at the scheduled time may also incur a service or trip fee.

7. Limitation of Liability
  • The Company is not liable for damages to property, driveways, landscaping, or structures unless due to gross negligence or willful misconduct.

  • The Client releases the Company from any liability for items removed at the Client’s direction.

  • The Company is not responsible for identifying items of value unless clearly communicated by the Client.

8. Indemnification

The Client agrees to indemnify, defend, and hold harmless ClearPaths and its employees or contractors from any claims, damages, or expenses arising out of the Client’s breach of this Agreement or misuse of the services provided.

9. Termination

The Company reserves the right to terminate this Agreement or refuse service if unsafe conditions exist, prohibited materials are present, or the Client is found to be in breach of this Agreement.

10. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of New York. Any legal action or proceeding arising under this Agreement shall be brought in a court of competent jurisdiction in New York County, New York.

11. Entire Agreement

This Agreement represents the entire understanding between the parties and supersedes any prior communications or agreements. No amendment to this Agreement will be valid unless in writing and signed by both parties.
